[glow=red,2,300]Garry Reed Wrote:[/glow] Forget human rights. I want animal rights!Humans can be convicted of animal abuse if they inflict "mild discomfort" upon un-humans. So say justicecrats in Washington State. Prosecutors were having trouble proving that a pair of ponies actually suffered pain, so the state Court of Appeals in Tacoma helpfully redefined creature discomfort for them. Animal anguish, it declared, not only includes "mild discomfort" but also "mental uneasiness," "dull distress" and "unbearable agony."My neighbor's neglected yard gives me mild discomfort, idiot drivers cause me mental uneasiness, my job sometimes fills me with dull distress, and politicians almost always give me unbearable agony. Horse sense tells me that I should be able to convict my tormenters of second-degree animal cruelty, the going penalty for such torment. But, no. While my animal rights have certainly been violated under Washington State's recently concocted critter codes, my human rights haven't been despoiled one bit.As one animal rights advocate put it, the court's decision "will guard against psychic pain as well as physical discomfort."Psychic pain? Does that mean instigating animal angst is also outlawed?

Fuck PETA. I'm a vegetarian because eating animal flesh makes me feel sick and saps my energy out, and I wear leather pants because my ass looks good in it and I love to make my man horny. Problem? Not from where I stand! ;D

Well this was a clever, well written, humerous paper but I still don't know what conditon the horses were found in and what the circumstanses of the case are. I could never make an informed decision on this particular case with the information printed here. Where are the facts of the case? As someone who participated in horse shows for 12 yrs, I can tell you there is a lot of abuse especially by the big time trainers. The inspectors also act like the gestapo when their inspecting your horses though. We were once eliminated from a show because our horse had a callous and that apparently signifies abuse. My girlfriend was livid. She was like, "My horse and I train hard to perform well. I have callouses on my hands from training. The horse wasn't lame at all. He was fine. We were treated the same as if we would have intentionally hurt our horse that we loved. But I do love my animals and It upsets me when they are treated cruelly. I think any bastard that tortures an animal should be convicted.

My concern with this is not whether there was abuse or not, but whether a judge can redefine abuse to fit the case right in front of him. Ithink the key section of the essay, for me, is:

This guy is so into his horse metaphors and stabs at humour with each new sentence that he left out the story. It's difficult to have any kind of opinion from this. At least for me.

Besides, no matter how good I am - he's published. Did you see you are a Senior Member now? You're the only one I've seen so far... - Rick

Guess I need to jump into this one. Rick nailed the point of my article when he said, "My concern with this is not whether there was abuse or not, but whether a judge can redefine abuse to fit the case right in front of him." It's not an animal abuse story, it's a legal corruption story. But the original article is here: seattlepi.nwsource.com/local/158071_horse26.html

The saddest thing is they never even seemed concerned at all with the broader Constitutional impact of this ruling. What good is a free press if they are lobotomized?? The only truly free press is you and me and others like us, pounding away on our keyboards and uploading Truth to the internet. Kudos, Garry! - Rick

Let me just add that if the statute is not broad enough, that issomething the State Legislature needs to address, not the courts.
